The following is an updated edition of an article I wrote that was published in the Society of Australian Genealogists’ journal Descent, Volume 34, Part 3, September 2004, pages 129 to 135 (174 entries). The updated information has been extracted from, first an article in Descent, Volume 39, Part 2, June 2009, pages 59 to 65, titled “A further look at Australian Probate Records in the Prerogative Court of Canterbury” by Michael Andrews-Reading (30 entries), second an item in Descent, Volume 39, Part 2, September 2009, page 132, titled “More Australian Wills held in the Prerogative Court of Canterbury” (11 entries).

Wills 1384 to 1858
The UK National Archives (1), the new name for the Public Record Office and the Historical Manuscripts Commission, London, has made available on their Documents Online web site (2) the index to over one million wills of the Prerogative Court of Canterbury (PCC) covering the period 1384 to 1858. Copies can be purchased and received online generally for £3.50 sterling (current in 2009).

Until 1858 all wills had to be proved by the Church and other courts. The Prerogative Court of Canterbury, the most important of these courts, dealt with relatively wealthy individuals living mainly in the south of England and most of Wales (what was originally within the ecclesiastical province of Canterbury. The date given relates to when the will was proved.
Entries have been found using the very good online search facilities for surnames of those indexed with the names of various colonies and the place name field for others in Australia, as follows. The results were :-
Australia – 27 entries
New South Wales – 116 entries
Van Diemen’s Land – 41 entries
Tasmania – 1 entry
Port Phillip – 2 entries
Victoria – 11 entries
Queensland – no entries
Norfolk Island – 1
UK – 13
Other – 4
Total 215 entries less seven duplicates = 208
Readers will observe that the list includes many well known early Australian identities such as: The Right Reverend William Grant Broughton, Sir James Dowling, Sir George Gipps, George Howe, Phillip Parker King, Reverend Robert Knopwood, Sir Maurice Charles O’Connell, Captain William Paterson, John Oxley, and Thomas Braidwood Wilson. On the other hand the list includes Benjamin Lord, Labourer, of Newton near Geelong. The earliest date is for Andrew Miller, Commissary of the New Settlement at New South Wales, 17 January 1791.
Also Andrews-Reading noted that the list includes eight First Fleeters, including Henry Edward Dodd, “alias Edward Dodd”. He also notes that the earliest Australian will was for another First Fleeter, William Wall, who died in 1789, but proved on 26 July 1792. I have included the 30 additional entries listed by Andrews-Reading in the list below. He identified quite a few well known people, including Richard Atkins, John Thomas Bigge, William Bligh, Sir Richard Bourke, John Hunter, Philip Gidley King, Lachlan Macquarie, Arthur Phillip, even though they did not die in Australia.
There may be other PCC wills that have not been found that relate to people who have lived or died in Australia. Therefore if someone checking this list does not find an entry, I recommend checking the National Archives index.
